Terms of sale

The seller.

Every order placed on privosa.com is a contract with Privosa Fine Jewelry, 6222 Richmond Ave. Suite 799, Houston, TX 77057, United States. Placing an order means you accept these terms, together with the returns, shipping and privacy policies they refer to. Please read them before you buy — they are short, and they are written to be understood.

When the sale is made.

Placing an order is an offer to buy. The sale is made when we email you a confirmation and take payment. Until then we may decline an order — because a piece sold out between your basket and your checkout, because we cannot verify the payment or the address, or because a price was displayed in error.

If we decline an order that has already been charged, we refund it in full, immediately, and we tell you why.

US dollars — and what happens if we get one wrong.

All prices are in US dollars and include complimentary insured shipping. Any sales tax that applies is handled at fulfilment and shown on your order confirmation, which is the authoritative record of what you were charged.

Prices change; the price that binds us is the one shown when you placed the order. If a piece is listed at an obviously wrong price through human or technical error, we will contact you and give you the choice of paying the correct price or cancelling for a full refund. We will not simply charge you the difference.

Taken by Square, not by us.

Card payments are processed by Square. Your card details are entered into Square's own secure form and never pass through or rest on our servers — we receive only a reference to the payment. Payment is taken in full at the time of the order.

How a code works.

Promotional codes are applied to the subtotal at checkout, one per order, and cannot be combined or applied after an order is placed. The current welcome offer, 10% off your first order, is limited to a first order. We may withdraw or change an offer at any time; doing so never affects an order already confirmed.

What we promise about what we sell.

• Every piece is solid 14-karat gold and hallmarked. We do not sell gold-plated or gold-filled jewelry.
• Diamonds are genuine — natural mined or laboratory-grown, both of which are real diamonds. Which one a piece contains is stated on its page.
• Every piece ships with a Certificate of Specification setting out carat, colour, clarity, cut and setting.
• Where a stone has been independently graded by IGI we say so, and the report is available on request. Where it has not, we say that too. We never imply a certificate that does not exist.
• Carat weights on this site are the total weight of all stones in a piece unless its page says otherwise.

Photographs are taken to represent each piece as faithfully as we can, but stones vary and screens differ. Small variations in the exact appearance of a natural stone are the nature of the material, not a fault. If a piece is not what you expected when you see it, the returns policy exists for exactly that.

Shipping is complimentary, insured and signature-required, arriving within about 5 business days — the shipping policy has the detail. You may return a piece within 30 days of delivery for a full refund, issued within 5 business days of its return; the returns policy has the detail, including the few exceptions. Both policies form part of these terms.

Risk in a piece passes to you on delivery. Title passes when we have received payment in full.

Using the site.

If you create an account, keep its credentials to yourself and tell us if you think someone else has them. Everything on this site — photographs, text, the Privosa name and marks — belongs to us and may not be copied for commercial use. You agree not to interfere with the site, or to extract data from it by automated means beyond ordinary search indexing.

The limits — and what they do not touch.

Our liability for any order is limited to the amount you paid for it. We are not liable for indirect or consequential losses.

Nothing in these terms limits any right you have under the law of your state that cannot be limited, and nothing here excludes liability for fraud, for death or personal injury caused by our negligence, or for a defective product. If a court finds any provision here unenforceable, the rest stands.

Texas.

These terms are governed by the laws of the State of Texas, and the courts of Harris County, Texas have jurisdiction over any dispute — without depriving you of the protection of any mandatory consumer law of the state in which you live.

Before anything reaches a court we would much rather hear from you. Most disputes end with a phone call.
